The H-2B Process

The H-2B Process for guest workers takes approximately four months, from the initial application to the arrival of the workers in the USA.

Step 1: We discuss your business and staffing needs to ensure the H-2B Program will match your needs. We will need to collect and review payroll records for the last two years. This provides evidence that your need is seasonal. Please fill out the Employers Application for a free evaluation and price quote.

Step 2: We arrange your presentation of all paperwork and supporting evidence to file with the Department of Labor.

Step 3: Job advertisements are placed in local newspapers to ensure there are no suitable U S workers available. At the same time we start recruiting and screening foreign guest workers applications for you to review.

Step 4: Upon receiving DOL approval, you chose which foreign guest worker to hire. We send employment Agreements to guest workers for their approval and signatures. For a very small fee background and drug screening can also be done.

Step 5: We submit H-2B paperwork to the United States Citizenship and Immigration Services. Once approval has been received, we notify you and the employee.

Step 6: We arrange for employees to apply for H-2B visas in their home country. After guest workers receive their visas, we arrange transportation to the U S, and to your location.

Step 7: Guest Workers arrive at local airport or bus terminal and are your responsibility. On going support by Mid States Labor Solutions is provided for both employer and Guest Workers.
